Order for arrest and seizure, etc.

Section 675 empowers the court to order the arrest of company officers and the seizure of their books, papers, and movable personal property during a winding up, where those individuals are attempting to abscond or hide assets.

  • The court may act once a winding-up petition has been presented or a voluntary winding-up resolution has been passed
  • Action can be taken where there is probable cause to believe a contributory, director, shadow director, secretary, or other officer is about to leave the State, abscond, or conceal property to evade payment of calls or avoid examination
  • The court may order the arrest of the individual and the seizure or securing of their books, papers, and movable personal property, with detention lasting as long as the court directs
  • The court may act on its own initiative or on application by the Corporate Enforcement Authority, a creditor, or any other interested party
