Definition (Chapter 15)

Section 710 provides the definition of "insolvency proceedings" for the purposes of Chapter 15, which deals with provisions related to the EU Insolvency Regulation, and addresses the translation of creditor claims lodged with a liquidator.

  • "Insolvency proceedings" means proceedings opened in the State under Article 3 of the EU Insolvency Regulation where they relate to a company.
  • A creditor referred to in Article 42(2) of the Insolvency Regulation may lodge a claim with a liquidator.
  • If a claim is not in Irish or English, the liquidator may require it to be translated into either of those languages.
  • The liquidator may request translation of the entire claim or only specific parts of it.
