Right of access to accounting records

Section 386 establishes the right of a company's statutory auditors to access the company's accounting records at all reasonable times.

  • Statutory auditors have a legal right to access a company's accounting records.
  • This right of access applies at all reasonable times, not just during a formal audit period.
  • The company cannot refuse or obstruct the auditors from reviewing its records.
  • This provision replaces the equivalent right previously contained in section 193(3) of the Companies Act 1990.
