Types of disclosure order

Section 801 sets out the three types of disclosure order the court may make to investigate interests in a company's shares or debentures.

  • The court can order any person believed to hold or be able to obtain relevant information to disclose the names and addresses of those with current or past interests in shares or debentures, and of any representatives acting on their behalf.
  • The court can order a person believed to have a current or past interest in shares or debentures to confirm or deny that interest, and if confirmed, to provide any further information the court requires.
  • The court can order a person with an interest in specified shares or debentures to disclose the identity and address details of other interested parties and their representatives, along with any additional information the court may require.
  • These orders enable the court to establish the true ownership of, and interests in, a company's shares or debentures by compelling disclosure from anyone who holds or can obtain the relevant information.
