Fees

Section 889 deals with the Minister's power to make regulations prescribing fees payable to the Registrar of Companies for registration of companies, filing of documents, and other tasks the Registrar carries out under the Act.

  • The Minister may set fees for company registration, filing documents or notices, and any other action the Registrar is required or authorised to perform under the Act
  • Fees remain payable even where the registration or other action is declined by the Registrar, not proceeded with, or withdrawn by the applicant
  • Higher fees may be set for late filings, calculated by reference to the length of time by which the relevant deadline has been exceeded
  • The Registrar is not obliged to carry out the requested action unless the prescribed fee has been paid, and all fees collected are paid into the Exchequer
