Enforcement in State of insolvency judgments

Section 1422 sets out the procedure for enforcing insolvency judgments from other EU member states in Ireland, including the role of the Master of the High Court and the effect of enforcement orders once granted.

• Applications to enforce foreign insolvency judgments in Ireland must be made to the Master of the High Court under the Brussels 1 Regulation framework.
• The Master must declare the judgment enforceable immediately once the required formalities are completed, without conducting any review of its substance.
• Preservation measures (such as freezing orders) may be sought alongside the enforcement application and must be granted by the Master when an enforcement order is made.
• Once an enforcement order is granted, the foreign insolvency judgment carries the same force and effect as a judgment of the Irish High Court and can be enforced accordingly.
