Companies Act 2014 section 781

Saving in relation to section 780, etc. and corresponding amendments effected to Act of 1990 by Companies (Amendment) Act 2009

Section 781 protects the validity of directions previously issued by the Director of Corporate Enforcement requiring third parties to produce books or documents, ensuring that later legislative changes cannot be used to cast doubt on the legality of those earlier directions.

  • The section safeguards directions given by the Director before the Companies (Amendment) Act 2009 was passed, confirming they were not limited in effect or scope.
  • Books or documents produced to the Director or the Corporate Enforcement Authority on foot of those earlier directions are confirmed as having been lawfully produced.
  • Neither the original 2009 amendments to section 19 of the Companies Act 1990, nor the equivalent provisions in section 780 or elsewhere in this Chapter, should be read as implying any prior deficiency in the Director's powers.
  • The section essentially reproduces section 4(2) of the Companies (Amendment) Act 2009, carrying forward the same saving provision into the consolidated Companies Act 2014.
