Appointment of chairperson of Authority

Section 944G sets out the rules for appointing the chairperson of the Corporate Enforcement Authority, their casting vote, temporary replacement arrangements, and their general management responsibilities.

  • Where the Authority has more than one Member, the Minister appoints one as chairperson, with any additional allowance subject to approval by the Minister for Public Expenditure and Reform.
  • The chairperson holds a casting vote in the event of a tied decision and, where the Authority has only one Member, that Member is automatically the chairperson.
  • If the chairperson is unavailable due to absence or incapacity, the Minister appoints a temporary replacement, who may be another Member or a member of staff.
  • The chairperson is responsible for managing and controlling the staff, administration, and general business of the Authority.
