Effect of reservation of name

Section 29 sets out the legal effect of reserving a company name, ensuring that the reserved name is protected during the reservation period for the exclusive use of the person who reserved it.

• During the reservation period, no company may be incorporated using a reserved name unless the application comes from the person who reserved that name.
• No company may be incorporated with a name that the Registrar considers too similar to a reserved name during the reservation period.
• An existing company cannot change its name to a reserved name, or to one too similar to it, unless that company is the one that reserved the name.
• When the person who reserved the name proceeds to incorporate a company using it, the incorporation fee is reduced by the amount already paid for the name reservation.
