Liability in case of death of contributory

Section 661 deals with what happens to a contributory's liability to the company when that contributory dies, and the obligations that fall on their personal representatives.

  • If a contributory dies, their personal representatives become responsible for the contributory's liability to the company
  • This applies whether or not the deceased had already been placed on the list of contributories
  • The personal representatives are treated as contributories themselves for the purpose of settling the deceased's liability
  • If personal representatives fail to pay money ordered, legal proceedings can be taken to administer the deceased's estate and compel payment from it
