Requirements for Chapter to apply

Section 486 sets out the conditions that must be met before the division provisions in this Chapter can apply to a group of companies.

  • This Chapter only applies when specific company-type conditions are satisfied
  • No company involved in the division may be a public limited company (PLC)
  • At least one of the companies involved must be a private company limited by shares (LTD)
  • If either condition is not met, the Chapter does not apply and alternative provisions must be considered
