Supplementary court orders

Section 742 sets out the additional orders a court may make when it restores a company to the register, covering directions to reinstate the previous position, name changes, officer liability for debts incurred while struck off, and any other orders the court considers appropriate.

• The court may direct that the company and all other persons be placed, as far as possible, in the same position as if the company had never been struck off the register.
• If the company's name is now too similar to that of another company on the register, or to a name that has been reserved, the court may order the restored company to change its name.
• The court may hold one or more officers of the company personally liable for any debt or liability incurred by or on behalf of the company during the period it was struck off.
• The court retains a general discretion to make any other order it considers appropriate in the circumstances.
