Information disclosed under order

Section 813 sets out how information must be provided when a person is subject to a disclosure order, including the form of the response, identification requirements, and how the court handles the disclosed information.

  • A person subject to a disclosure order must provide the required information by way of a written notice
  • The written notice must include the identity and current address of the person providing the information, and failure to include these details means the order has not been complied with
  • Once information is provided to the court in compliance with the order, a prescribed court officer must pass it on to both the applicant and the company, unless the court directs otherwise
  • The court may direct that only part of the information be shared, and in making such a direction it must consider whether the requirements of section 812 have been met
