Certificate by Registrar admissible as evidence of facts stated

Section 893 deals with the evidential value of written certificates issued by the Registrar of Companies in legal proceedings.

  • A written certificate signed by the Registrar is admissible as evidence in all legal proceedings without the need for further proof.
  • The certificate can confirm the contents of any register maintained by the Registrar.
  • It can also confirm the date on which a document was filed, registered, delivered to, or received by the Registrar.
  • The certificate may state the most recent date on which a requirement under the Companies Act was complied with, and this is accepted unless evidence to the contrary is provided.
