Remuneration of receivers

Section 443A sets out the basis on which a receiver is entitled to remuneration, including the different methods by which their fees may be expressed in the instrument of appointment.

  • A receiver's entitlement to remuneration is governed by the terms agreed, fixed or otherwise set out in the instrument under which they are appointed.
  • Remuneration may be expressed as a relevant percentage, such as a percentage of assets realised during the receivership.
  • Remuneration may alternatively be calculated by reference to the time the receiver spends conducting the receivership, for example at agreed hourly or daily rates.
  • Any other method or basis of calculation may also be used if specified in the appointment instrument, and the court retains a power under section 444 to fix or adjust the receiver's remuneration.
