Regulations (Chapter 1)

Section 1354 empowers the Minister to make regulations to give further effect to the EU Prospectus Regulation and to supplement the related delegated acts, including the power to create offences and revoke earlier instruments.

  • The Minister may make regulations to further implement the EU Prospectus Regulation and to supplement and make consequential provision for delegated acts under that Regulation.
  • Such regulations may include incidental, supplementary and consequential provisions as the Minister considers necessary or expedient.
  • The regulations may create offences, but penalties may only be imposed on summary conviction; they may also revoke instruments made under other legislation.
  • This regulation-making power operates independently of, and does not limit, the separate power to make regulations under section 3 of the European Communities Act 1972.
