Supplementary rules, etc., by competent authority

Section 1370 empowers the Central Bank of Ireland, as the designated competent authority for market abuse law, to make supplementary rules and issue guidelines to ensure compliance with and effective supervision of Irish market abuse law.

  • The Central Bank may impose requirements on persons subject to obligations under Irish market abuse law, including mandating specific procedures and forms for providing information
  • Rules may require reporting and disclosure of relevant matters at specified times and in a specified manner to support the Central Bank's supervisory role
  • Rules must not contradict Irish market abuse law or require information unrelated to the purposes of the EU Market Abuse Regulation, the Commission Implementing Directive, or the CSMA Directive
  • Administrative sanctions available under Irish market abuse law for breaches of that law can equally be imposed for breaches of rules made under this section
