Notification of appointment of examiner

Section 531 sets out the notification requirements that must be followed when a petition to appoint an examiner is presented and when an examiner is subsequently appointed, including public announcements, filings with the Registrar, and disclosure on company documents, websites, and emails.

  • The petitioner must deliver notice of the petition to the Registrar within 3 days, and the examiner must publish notice of appointment in Iris OifigiΓΊil within 21 days and in at least 2 local daily newspapers within 3 days.
  • The examiner must deliver a copy of the appointment order to the Registrar within 3 days of being appointed.
  • All company invoices, orders for goods, business letters, emails to third parties, and the company website must clearly state that the company is "in examination under Part 10 of the Companies Act 2014".
  • Failure to comply with any of these notification and disclosure requirements is a category 4 offence, applying to the company, its officers, and any person acting on its behalf as appropriate.
