Resignation, removal, disqualification of Member

Section 944H sets out the rules governing how a Member of the Corporate Enforcement Authority may resign, be removed from office by the Minister, or become automatically disqualified from holding office.

  • A Member may resign by letter to the Minister, taking effect on the date stated in the letter or the date the Minister receives it, whichever is later
  • The Minister may remove a Member due to ill-health, stated misbehaviour, or where removal is necessary for the Authority to perform its functions effectively
  • Where a Member is removed, the Minister must give written reasons and lay a copy of those reasons before each House of the Oireachtas
  • A Member is automatically disqualified from office upon bankruptcy, arrangement with creditors, imprisonment, conviction of certain offences, or being subject to a restriction or disqualification order
