Relief from liability under section 828

Section 830 allows a person who is liable to a company for payment in respect of shares under section 828 to apply to the court for full or partial exemption from that liability.

  • A person liable to a company under section 828 for payment in respect of shares may apply to the court for relief from that liability.
  • The application may seek either full or partial exemption from the liability.
  • The court has discretion to grant the exemption to the extent it considers just and equitable to do so.
  • This relief provision originated from section 155(3) of the Companies Act 1990, which applied sections 32 to 36 of the Companies (Amendment) Act 1983.
